1. Overview

These Terms of Service (“Terms”) govern your access to and use of the websites, content, products, and services provided by Well Witness LLC (“Well Witness,” “we,” “us,” or “our”), including:

  • Our main website at https://wellwitness.org and all related pages and content.

  • Old Modern Wellness – wellness content and products focused on spiritual disciplines, naturopathy, herbalism, fitness, and nutrition (including herbal teas and tinctures).

  • ODYV – fashion, beauty, and design offerings, including faith‑based apparel and all‑natural herbal cosmetic products.

  • Well Wit – Christian‑themed stationery and materials such as journals, notebooks, and printed resources.

Together, these are the “Services.” We primarily serve users in Texas and the United States but may expand internationally.

By accessing or using the Services—whether online or at vendor events, pop‑up shops, or gatherings—you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

  • You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make purchases or create an account.

  • If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

  • By using the Services, you represent that you have the legal capacity and authority to enter into these Terms.

3. Accounts and security

  • You may need an account to access certain features (for example, commenting, submitting content, or purchasing products).

  • You agree to provide accurate, current, and complete information and to update it as needed.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

  • You agree to notify us promptly if you suspect unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion, subject to applicable law.

4. Faith‑based content and community conduct

Well Witness is a Christian, faith‑based community. By using the Services, you agree to:

  • Engage respectfully with others, even where you may disagree.

  • Refrain from harassment, hate speech, threats, or abusive, obscene, or profane content.

  • Refrain from posting content that is defamatory, fraudulent, misleading, or unlawful.

  • Respect the worship and devotional nature of spaces such as prayer calls, testimony sharing, livestream Bible reading, and talent‑sharing videos.

We may moderate, remove, or restrict content or users that violate these expectations or these Terms.

5. User‑generated content

You may be able to submit, upload, or share content through the Services, including testimonies, comments, prayers, creative works (poems, songs, videos, visual art), and other materials (“User Content”).

By submitting User Content, you:

  • Represent and warrant that you own or have the necessary rights to share it, and that it does not infringe or violate any third‑party rights or applicable law.

  • Grant Well Witness a non‑exclusive, worldwide, royalty‑free, sublicensable license to use, reproduce, display, perform, adapt, modify (for formatting or technical reasons), distribute, and promote your User Content in connection with providing and promoting the Services.

  • Understand that certain User Content, especially testimonies or creative works you choose to share publicly, may be visible to other users or the public.

We may remove or decline to display any User Content at our discretion, including content that is inappropriate, unlawful, or inconsistent with our mission and values.

You are solely responsible for your User Content and any consequences of sharing it.

6. Spiritual, wellness, and herbal products (not medical advice)

Our content and products, including those from Old Modern Wellness, may include information and perspectives on spiritual disciplines, prayer, wellness, naturopathy, herbalism, fitness, and nutrition (such as herbal teas, tinctures, and remedies).

  • No medical claims: All content and products are provided solely for general informational, educational, and personal wellness purposes. They do NOT constitute medical, therapeutic, psychological, nutritional, or professional health advice, diagnosis, treatment, or cure.

  • Herbal products specifically: Herbal teas, tinctures, cosmetics, and related items are not intended to diagnose, treat, cure, or prevent any disease. They are traditional remedies offered as dietary supplements where applicable. Results vary by individual; they are not FDA-evaluated or approved for medical use.

  • Consult professionals: Always consult a licensed physician, pharmacist, or qualified healthcare provider before using any herbs, supplements, or wellness practices—especially if you have health conditions, are pregnant, nursing, on medication, or giving to children. Never use our products to replace prescribed treatments.

  • Risk disclosure: Herbal products may cause allergic reactions, interactions, or side effects. Review all labels, warnings, and instructions before use. Discontinue use if adverse effects occur and seek medical help.

  • No guarantees: We make no representations about efficacy, safety, or suitability for your needs. Use at your own risk.

At vendor events, we will provide disclaimers matching this section.

7. Products, pricing, and orders

We offer both physical and digital products through Well Witness, Old Modern Wellness, ODYV, and Well Wit, including apparel, herbal products, cosmetics, books, stationery, and other items. Our products may be sold:

  • Online through wellwitness.org and related platforms, and

  • In person at pop‑up shops, vendor events, conferences, and similar gatherings.

  • Product descriptions, images, and details are provided as accurately as possible, but we do not warrant that descriptions or other content are error‑free, complete, or current.

  • Prices, taxes, and fees may vary between online and in‑person events and are subject to change without notice.

  • Applicable sales tax will be added where required by law (for example, for sales in Texas).

  • We reserve the right to limit quantities and to reject, cancel, or correct orders (online or in person), including due to errors in pricing, availability, or suspected fraud.

  • Your order or purchase is an offer to buy; we may accept or decline it at our discretion. Acceptance typically occurs when we issue a receipt, order confirmation, or deliver the product.

If we cancel an order after payment has been processed, we will issue a refund for the applicable amount in line with our refund practices and payment provider rules.

8. Shipping, returns, and refunds

Our shipping, return, and refund practices may differ between online orders and in‑person purchases and will be described on the Site, on receipts, or at the point of sale.

In general:

  • Shipping for online orders

    • Shipping times are estimates and may depend on your location and carrier performance.

    • You are responsible for providing accurate shipping information; we are not responsible for lost items due to incorrect addresses.

  • Vendor events and in‑person purchases

    • Some items purchased at events may be final sale, especially consumables, herbal products, cosmetics, or heavily discounted items, where permitted by law.

    • Where returns or exchanges are allowed, items typically must be unused, in original condition, and returned within the timeframe stated on your receipt or event signage.

  • Limitations

    • For health and safety reasons, certain items (for example, opened herbal products, used cosmetics, or personalized items) may not be returnable.

    • Digital products and downloads are generally non‑refundable once delivered or accessed, unless required by law.

Please review the applicable shipping and return information before purchasing, whether online or at an event.

9. Events & Gatherings

We may host, attend, or participate in vendor events, pop‑up shops, conferences, and faith‑based gatherings.

  • Photography and video: We may photograph or record events (including attendees, speakers, performances, and activities) for promotional, educational, or archival purposes. By attending, you grant us permission to use such images or footage featuring you (including your likeness, voice, or testimony) on our website, social media, newsletters, or other materials, unless you notify us in writing beforehand that you do not consent.

  • Testimonies and sharing: If you voluntarily share a testimony, prayer need, or story at an event, you grant us the same permissions as User Content (Section 5) to use, share, or feature it.

  • Minors: Photos or recordings of children require parental consent, which we will seek where practicable.

You may request removal of specific images or content by contacting us, subject to our discretion and legal rights.

10. Intellectual property

The Services and all content provided by us, including text, graphics, logos, images, videos, audio, designs, and other materials (excluding User Content), are owned or licensed by Well Witness and are protected by copyright, trademark, and other laws.

  • “Well Witness,” “Old Modern Wellness,” “ODYV,” “Well Wit,” and associated logos and branding are our trademarks or service marks.

  • You may not use our trademarks or branding without our prior written permission.

  • Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your personal, non‑commercial use.

You may not copy, distribute, modify, create derivative works of, publicly display, or exploit any part of the Services except as expressly allowed by these Terms or applicable law.

11. Prohibited uses

You agree not to use the Services:

  • For any unlawful purpose or in violation of any applicable law or regulation.

  • To send spam, unsolicited messages, or fraudulent content.

  • To upload or distribute viruses, malware, or other harmful code.

  • To interfere with or disrupt the operation or security of the Services or any networks or systems connected to them.

  • To attempt to gain unauthorized access to any account, data, or system.

We may suspend or terminate your access for any prohibited use, subject to applicable law.

  • We do not control and are not responsible for third‑party sites or services.

  • Your use of third‑party sites is at your own risk and subject to their terms and policies.

The Services, including all content and products, are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, to the maximum extent permitted by applicable law.

Without limiting this, we do not warrant that:

  • The Services will be available in any particular country or region at all times.

  • The Services or products will meet local legal or regulatory requirements outside the United States.

  • The Services will be uninterrupted, secure, or error‑free.

  • Any content, including spiritual or wellness content, will meet your expectations or specific needs.

  • Defects or errors will be corrected.

If you access the Services or purchase products from outside the United States, you are responsible for complying with any local laws and regulations that apply to you.

You use the Services and any products at your own risk.

14. International users

While we primarily serve users in Texas and the United States, people from other countries may also access our Site and content.

  • If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with any local laws that apply to you.

  • We do not represent that the Services, or any products or content, are appropriate or available in every jurisdiction.

  • International orders, if and when offered, may be subject to additional shipping costs, customs duties, taxes, import restrictions, and delays; you are responsible for any such charges and compliance with import requirements in your country.

By using the Services, you understand that your information may be transferred to, stored in, and processed in the United States.

15. Limitation of liability

To the fullest extent permitted by law:

  • Well Witness, its owners, officers, employees, agents, affiliates, and subsidiaries will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including loss of profits, data, or goodwill) arising out of or in connection with your use of or inability to use the Services or products.

  • Our total aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid to us for the specific product or service giving rise to the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

Some jurisdictions do not allow limitations of certain damages, so some of the above limitations may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Well Witness, its owners, officers, employees, agents, affiliates, and subsidiaries from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • Your use of the Services or products.

  • Your violation of these Terms.

  • Your User Content.

  • Your violation of any law or the rights of any third party.

17. Governing law and dispute resolution

These Terms and your use of the Services are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles.

  • Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Harris County, Texas, unless a different forum is required by applicable law that cannot be waived.

  • You and Well Witness consent to the personal jurisdiction and venue of these courts.

Where permitted by law, you and Well Witness agree to first attempt to resolve disputes informally by contacting each other using the information in Section 19 and allowing a reasonable time for resolution.

18. Termination

We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, if we reasonably believe:

  • You have violated these Terms or any other policy.

  • Your use poses a security or legal risk to us or others.

  • We discontinue the Services in whole or in part.

You may stop using the Services at any time. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will continue to apply.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we may provide additional notice (such as by email or a notice on the Site).

Your continued use of the Services after the new Terms take effect constitutes your acceptance of the updated Terms.
